Efficient & Transparent

Our Process

01

Consultation

We meet you where you are: In person - over a call - or through an online meeting like Zoom, Google Meet, etc. We address your concerns, answer any questions, and capture your needs.

The consultation is free because we want to make sure we can help. There may be times when we recommend different professionals, services or representation. Even after over 20 years in legal practice, needs can be unique. If this ever happens, we will not expect payment and will attempt to help you locate a resource.

You are never under an obligation to choose our services.

02

Case Evaluation

Our team carefully examines your situation. We review any existing documents and communicate with you on options for moving forward to accomplish your plans.

Establishing an attorney client relationship ensures your issues make you the priority.

If you select our services, we ask for a partial payment to establish our formal representation. This allows us to jump straight into the work - communicating with others and securing your interests. Our preference is half of our fee at the time of engagement with the remaining half of the payment issued when the work is complete.

We understand every financial situation is unique; some clients prefer to pay in full while others utilize a flexible payment plan. Our goal is to meet you where you are.

We are honest and transparent whether or not you become a client.

03

Legal Strategy

After meeting with us, we create customized legal instruments tailored to ensure your rights and future are protected.

We meet in a manner of your choosing to go over the documents ensuring they accomplish what you need.

We will be there to ensure the instruments we created for you are sound and current with prevailing law.

04

Implementation

We keep you informed every step of the way.

Upon your approval of the protections created for you, we implement your chosen strategy.

These 4 steps are not entirely representative of our approach to serving you.

Richard was fantastic to work with! He worked with me remotely (over phone and email) to get POA documents set up for my elderly parents, so we as a family have peace of mind that these important legal documents are in place when needed. I highly recommend Richard and Faithful Elder Law Solutions and would definitely work with him again if I need additional attorney services for my parents.

Experiences

"I Survived" - Are you old enough to remember the, "I Survived" Series from Reader's Digest? Observed the series is now online. Not highlighting anything as dramatic, but these real world examples are not nearly as dramatic, but think about what could have went wrong.

We are here for you if it does or even if it doesn't.

Marie T. was a 78 year-old widow living in Florence, Kentucky. She is healthy, still drives, and attends church weekly. Her two adult children, both working professionals, notice subtle changes-forgotten bill payment and confusion over medications.

At a holiday dinner, Marie casually mentions she doesn’t want to be a “weight”. Her daughter insists talking with an elder law attorney “just to get organized.”

We were fortunate enough to connect. Marie has mental capacity, there is not an immediate crisis. She owned her home had a brokerage account, and significant savings.

Steps We Took Together

  1. Foundational Legal Planning
    • Updated Durable Power of Attorney (financial + healthcare)
    • HIPAA Authorization
    • Living Will / Advance Directive
    • Updated existing Will
  2. Asset Protection Planning
    • Medicaid Asset Protection Trust (MAPT) funded early
    • Retitle non-retirement assets
    • Preserve the home for heirs
  3. Care Strategy
    • Aging in place with part-time home care
    • Long-term care insurance review
    • Contingency planning for assisted living or skilled care

Outcome: When Marie started developing dementia, the family used the tools they created to transition smoothly to assisted living, then nursing care at a facility that works with Medicaid. No crisis. No family conflict. The home is protected.

Lesson: The optimal path begins before care is needed.

Ken H. is a 35 year old man living in Northern Kentucky. Because of a motor vehicle accident he is now permanently injured with children that depend on him. Ken initially tried to handle the claim process on his own, but as deadlines approached, reached out to Faithful Elder Law Solutions for assistance.

Outcome: Fortunately, the firm was able to properly position Ken’s claim and obtain a significant settlement before having to resort to litigation.

Lesson: We should all try to recognize when a life line may be needed

________

Cathy Z. is 54 year old woman living in Northern Kentucky. Her father died intestate (without a Will). She tried to handle the Probate herself, but realized this process was out of her depth of knowledge. Cathy contacted the firm.

Outcome: Not only did the firm work with the Probate court, it efficiently handled the matter to the point of Final Settlement by receiving an Order of Discharge to close the Estate. The firm took the necessary steps to efficiently handle the matter. It was handled in approximately 6 months instead of the usual 12.

Lesson: Consider involving an attorney sooner rather than later.
